General Terms and Conditions MMA Beauty

1. General
1.1. These general terms and conditions apply to all offers, orders, purchases, and agreements with MMA Beauty, whether via our webshop (www.mmabeauty.com), our physical store in Den Bosch, or via recognized third parties offering our products.
1.2. By placing an order or making a purchase at MMA Beauty, you agree to these general terms and conditions.
1.3. Deviations from or additions to these terms are only valid if expressly confirmed in writing by MMA Beauty.
1.4. MMA Beauty may amend or supplement these general terms and conditions at any time. The most recent version is always available on our website. For existing agreements, the terms and conditions in force at the time of purchase remain applicable, unless otherwise required by law.
1.5. If one or more provisions of these terms and conditions are null and void or annulled, the remaining provisions remain in full force.
1.6. MMA Beauty is based in Den Bosch, the Netherlands, and is registered with the Chamber of Commerce under number 72954892.

2. Product Information and Prices
2.1. MMA Beauty does its utmost to describe all products as completely and accurately as possible on the website and in other communications. This applies to product descriptions, specifications, images, prices, and availability.
2.2. Product images are for illustration purposes and may differ in some cases from the actual product, for example, due to colour rendering on different screens or changes by the manufacturer.
2.3. All listed prices include VAT and exclude any shipping costs, unless otherwise indicated.
2.4. MMA Beauty reserves the right to change prices at any time. Price changes do not affect orders that have already been placed and confirmed.
2.5. If there is a clear error in the price or product information, for example due to a technical malfunction or typographical error, MMA Beauty is not obliged to deliver the product at the incorrect price or with incorrect specifications. In such a case, we will contact you as soon as possible to correct or cancel the order.
2.6. All offers and promotions are valid while stocks last or during the specified promotional period.
2.7. Product availability is shown as accurately as possible. If an ordered product is unexpectedly unavailable, we will contact you immediately to find a suitable solution, such as an alternative product or a refund.

3. Ordering and Payment
3.1. Orders can be placed via our webshop www.mmabeauty.com, in our physical store in Den Bosch, or at selected third-party retailers.
3.2. MMA Beauty products are also available at recognized third-party physical stores, such as Sephora, Nocibé, Boutique 1 Beauty, and Healthy U. Availability and range may vary per retailer.
3.3. For purchases in our Den Bosch store, payment can only be made by debit card; we do not accept cash for the safety of our staff.
3.4. When you place an order via the webshop, you will immediately receive an automatic order confirmation by email with an overview of your order.
3.5. Payment must be made in full before the order will be shipped. In our webshop, you can pay securely using various payment methods, including iDEAL, credit card, Bancontact, PayPal, and other available options.
3.6. All payments are processed in a secure payment environment. MMA Beauty does not store customers’ payment details.
3.7. If a payment fails or is incomplete, the order will not be processed or shipped until the full amount is received.
3.8. In the event of a technical malfunction or pricing error on the website, MMA Beauty reserves the right to cancel or adjust the order. Of course, we will always contact you in such a case.
3.9. If you need an invoice for business purchases, you can indicate this during the ordering process or contact our customer service.
3.10. Gift cards or discount codes can be added during checkout. Only one discount code can be used per order, unless otherwise indicated.
3.11. All prices include VAT and exclude any shipping costs, unless otherwise stated.

4. Delivery and Shipping
4.1. MMA Beauty ships orders worldwide via DHL and PostNL, except to Russia, Israel, Iraq, and Afghanistan.
4.2. Orders are usually processed and shipped within 1-2 business days after receipt of payment. You will receive a shipping confirmation by email as soon as your order has been dispatched.
4.3. The estimated delivery time for orders within the Netherlands and Belgium is 1-3 business days. For other European countries, delivery usually takes 2-7 business days. International shipments outside Europe may take longer, depending on the destination and local customs procedures.
4.4. Orders within the Netherlands and Belgium over €35 are shipped free of charge. For orders under €35 or for international shipments, shipping costs are automatically calculated at checkout, based on the delivery address and the size of the order.
4.5. After shipping, you will receive a Track & Trace link to track your package.
4.6. MMA Beauty is not responsible for delays caused by carriers or customs, but we do our utmost to deliver your order as quickly as possible.
4.7. If an order cannot be delivered due to an incorrect or incomplete address, any additional shipping costs will be borne by the customer.
4.8. Upon receipt of your order, please check the package immediately for any damage or inaccuracies. If there are any issues, contact us as soon as possible via customerservice@mmabeauty.com, the live chat on our website, or via our social media channels.
4.9. For deliveries outside the European Union, import duties, customs fees, or local taxes may apply. These additional costs are the responsibility of the customer. MMA Beauty is not responsible for these charges or for any delays resulting from customs procedures. For deliveries within the European Union, no additional customs duties or import charges apply.

5. Right of Withdrawal (Cooling-off Period & Returns)
5.1. For consumers within the European Union, a statutory cooling-off period of 14 days after receipt of the product applies. Within this period, you may cancel (withdraw) your purchase without giving any reason and return the product.
5.2. If you wish to exercise your right of withdrawal, please notify us of your return within 14 days of receiving your order via customerservice@mmabeauty.com or via our return form on the website.
5.3. After notification, you have another 14 days to actually return the product. The product must be returned unused, unworn, in its original condition, with all tags, and in the original packaging.
5.4. The costs of returning the product are borne by the customer, unless otherwise agreed or if the product is defective or incorrectly delivered.
5.5. After receipt and inspection of the return, the full purchase amount, including any standard shipping costs for the original delivery, will be refunded within 10 business days via the original payment method. Any additional costs for a more expensive shipping method will not be reimbursed.
5.6. If the returned product is damaged or shows signs of use beyond what is necessary to assess the product, we reserve the right to charge depreciation.
5.7. Some products are excluded from the right of withdrawal, such as hygienic items whose seal has been broken after delivery. This will always be clearly stated with the relevant product.

6. Warranty
6.1. Our Asili makeup brushes come with a lifetime warranty from the date of purchase. If you use the brushes according to the instructions on our website, this warranty covers manufacturing defects and faults in materials or workmanship.
6.2. If you discover a defect within the warranty period, please contact us at customerservice@mmabeauty.com, including a description of the issue and, if possible, photos of the defect. We will assess your report and offer a suitable solution, such as free repair, replacement, or, if not possible, a refund.
6.3. The warranty on Asili brushes does not apply to damage caused by improper use, negligence, normal wear and tear, or if the product has been modified.
6.4. All other products are covered by the standard legal warranty as established under Dutch law. This means that a product must meet reasonable expectations and be free of defects that you would not expect under normal use during its expected lifespan.
6.5. The statutory warranty does not affect your rights as a consumer under Dutch and European law.

7. Complaints and Disputes
7.1. Do you have a complaint? Please contact us as soon as possible via customerservice@mmabeauty.com, our live chat, or our social media channels.
7.2. We aim to handle your complaint within 7 business days.
7.3. MMA Beauty is a member of the Dutch Disputes Committee (De Geschillencommissie). If your complaint is not satisfactorily resolved, you can submit it to the Disputes Committee for an independent assessment. 7.5. All agreements are governed by Dutch law. Disputes may be submitted to the competent court in the Netherlands or to the Disputes Committee.

8. Privacy
8.1. MMA Beauty attaches great importance to the protection of your personal data and acts in accordance with the General Data Protection Regulation (GDPR).
8.2. When placing an order or creating an account, your data will only be used to process your order, improve our services, and, if you have given permission, to send newsletters and offers.
8.3. Your data will not be shared with third parties, unless necessary for the execution of the agreement (for example, with delivery services) or if we are legally required to do so.
8.4. You have the right to view, correct, or delete your personal data. You can submit such a request via customerservice@mmabeauty.com.

9. Other Provisions
9.1. MMA Beauty reserves the right to amend or supplement these general terms and conditions at any time. The most current version is always available on our website.
9.2. All agreements between MMA Beauty and the customer are governed exclusively by Dutch law, unless mandatory law stipulates otherwise.
9.3. If one or more provisions of these general terms and conditions are found to be void or annulled, the remaining provisions shall remain in full force. In such a case, a new provision will replace the invalid one, as closely as possible reflecting the intent and purpose of the original.
9.4. Any communication between you and MMA Beauty may take place in writing or electronically. Electronic communication (such as email or messages via the website) is considered written communication.

10. Sustainability Initiative
10.1. MMA Beauty participates in the reforestation project of Evertreen.com, contributing to reforestation in Kenya.
10.2. For every customer, MMA Beauty offers the opportunity to have a tree planted in Kenya via Evertreen.com. This way, you directly contribute to combating deforestation, restoring local ecosystems, and creating employment for local communities.

10.4. MMA Beauty is not responsible for the content, operation, or accuracy of information from third parties, including Evertreen.com, and has no influence on the execution of the project by Evertreen or its local partners.
